Terms and Conditions

1. Introduction

Welcome to Growupsell, a product of Tenthspire Technologies ("Company," "we," "our," or "us"). By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.


2. Use of Our Services

  • You must be at least 18 years old to use our platform.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree not to use our services for any illegal, fraudulent, or unauthorized purpose, and to comply with the Acceptable Use rules in Section 6 and the Prohibited and Restricted Products list in Section 7.

    • 3. Account Registration

    To access certain features of Growupsell, you must create an account. You agree to provide accurate and complete information during registration.


    4. Payment and Fees

    Use of Growupsell may be subject to subscription fees, transaction fees, and other charges that vary by plan, region, and usage. For the most current details on plans, transaction fees, and any additional charges (such as premium services, custom development, or payment-gateway integrations), please review our Pricing page. Fees, plans, and applicable taxes may be updated from time to time, and the rates in effect at the time of your transaction or renewal will apply.


    5. Free Preview Subdomains

    As part of our onboarding experience, Growupsell may provide you with a free temporary subdomain (for example, yourbrand.growupsell.store) so that you can preview, configure, and demonstrate your eCommerce site before connecting a custom domain or subscribing to a paid plan. The following terms apply specifically to free preview subdomains:

  • Free preview subdomains are provided strictly for evaluation, demonstration, and non-production testing purposes, on an "as is" and "as available" basis.
  • We do not offer uptime guarantees, backups, performance SLAs, or data-retention commitments for free preview subdomains.
  • We reserve the right, at our sole discretion and without prior notice, to suspend, rename, reclaim, throttle, or permanently delete any free subdomain — including in cases of inactivity, abuse, fraud, non-payment, legal complaints, or violation of these Terms.
  • You may not use a free preview subdomain to process live commercial transactions at scale, to sell prohibited or restricted products (see Section 7), to engage in any illegal or unauthorized activity, or to distribute malicious content.
  • Subdomain names must not infringe any trademark, copyright, or third-party right, must not impersonate any person or organization, and must not contain offensive, deceptive, or unlawful terms. We reserve the right to refuse or revoke any subdomain at our discretion.
  • Free preview subdomains may display Growupsell branding, badges, or "Powered by Growupsell" attribution. You agree not to hide, remove, or modify such branding while using a free subdomain.
  • You are solely responsible for the content, products, customer data, taxes, refunds, and legal compliance of any store you operate under a Growupsell subdomain, whether free or paid.

    • 6. Acceptable Use and Prohibited Activities

    You agree to use Growupsell — including any website, subdomain, custom domain, API, mobile app, or service we provide — lawfully, in good faith, and in compliance with all applicable laws. You agree NOT to, and not to permit any third party to:

  • Violate any applicable local, state, national, or international law, regulation, or order — including consumer-protection, taxation, data-protection, anti-spam, anti-money-laundering, and export-control laws.
  • Engage in fraud, deception, money laundering, tax evasion, chargeback abuse, or facilitate any criminal activity.
  • Upload, distribute, or link to viruses, malware, spyware, ransomware, or any other harmful or malicious code.
  • Phish, impersonate, defraud, or deceive customers, partners, payment processors, or any other party.
  • Send spam, unsolicited promotional messages, bulk SMS or email, or otherwise violate anti-spam, telemarketing, or data-protection laws (including India's DPDP Act, GDPR, CAN-SPAM, and TCPA, where applicable).
  • Infringe upon any intellectual-property right, trademark, copyright, trade secret, publicity right, or privacy right of any third party.
  • Reverse engineer, decompile, scrape, crawl, mirror, or otherwise attempt to obtain unauthorized access to the platform, its source code, infrastructure, or other users' data.
  • Harass, threaten, defame, abuse, stalk, or otherwise harm any person or group.
  • Misrepresent your identity, business, location, affiliations, or the nature, origin, or quality of your products.
  • Exceed reasonable rate limits, abuse APIs, run automated bots, or otherwise place an undue load on our infrastructure or disrupt other merchants or customers.
  • Use the platform in a manner that could damage, disable, overburden, or impair the service, or interfere with any other party's use of it.

    • 7. Prohibited and Restricted Products

    Growupsell is a general-purpose eCommerce platform, and certain categories of goods and services are not permitted on stores hosted with us — whether on a free preview subdomain, a paid subdomain, or your own custom domain. You may not list, sell, advertise, promote, ship, or otherwise transact through Growupsell any product or service that is, or relates to:

  • Anything illegal under any applicable law in India or in the customer's jurisdiction, or items banned or restricted by RBI, FSSAI, BIS, DGFT, CDSCO, or any other regulatory authority.
  • Narcotic drugs, controlled substances, drug paraphernalia, or chemical precursors to such substances.
  • Tobacco, e-cigarettes, vaping devices, hookahs, and related products, where prohibited or without all required licenses.
  • Alcoholic beverages sold without all required permits and age-verification controls.
  • Firearms, ammunition, explosives, fireworks, weapons, weapon parts, or realistic replica weapons.
  • Hazardous, radioactive, biohazardous, or toxic materials and chemicals.
  • Human body parts, organs, blood, bodily fluids, or unauthorized medical or biological products.
  • Prescription medications, unapproved drugs, controlled medical devices, or any pharmaceutical product sold without proper authorization.
  • Adult content, pornography, escort or companionship services, or sexually explicit material.
  • Gambling, betting, lottery tickets, real-money fantasy games, or any game of chance not expressly authorized by law.
  • Counterfeit, replica, or unauthorized branded goods, or items that infringe any copyright, trademark, or patent.
  • Live animals, endangered species, ivory, animal trophies, or other wildlife products restricted under the Wildlife (Protection) Act or CITES.
  • Stolen goods, items obtained fraudulently, or goods that violate customs, import, or export laws.
  • Hate-speech merchandise, content that promotes terrorism, extremism, violence, or discrimination, or material that disturbs communal harmony.
  • Cryptocurrencies, virtual assets, securities, derivatives, or other regulated financial instruments offered without the required licenses.
  • Multi-level marketing (MLM), pyramid, Ponzi, money-circulation, or get-rich-quick schemes.
  • Personally identifiable data of third parties, hacking tools, surveillance equipment, or services intended to compromise the privacy or security of others.
  • Any other product or service we determine, at our sole discretion, to be high-risk, unethical, or harmful to our users, payment partners, or brand reputation.

    • We reserve the right to review any store hosted on Growupsell and, where we believe in good faith that a violation of Sections 5, 6, or 7 has occurred or is likely to occur, to remove listings, suspend stores, terminate accounts, withhold or reverse payouts, retain or delete data, and report violations to law enforcement and payment partners — in each case without prior notice and without liability to you. You agree to indemnify and hold Growupsell and Tenthspire Technologies harmless from any claims, losses, fines, or damages arising out of your violation of these sections.


    8. Intellectual Property

    All content, trademarks, logos, and intellectual property related to Growupsell belong to Tenthspire Technologies. You may not copy, distribute, or modify any part of our platform without prior written consent.


    9. Termination

    We reserve the right to suspend or terminate your account, take down any store or subdomain, and withhold pending payouts if you violate these Terms (including Sections 5, 6, and 7), engage in fraudulent or illegal activities, or otherwise misuse our services. Termination may be immediate and without prior notice.


    10. Disclaimer and Limitation of Liability

    Growupsell is provided "as is" without warranties of any kind. We are not liable for any loss or damages resulting from your use of the platform.


    11. Cookies and Tracking Technologies

    By using our website, you agree to our use of cookies and tracking technologies as described in our Privacy Policy. We use cookies and similar technologies, including Google Analytics and Google Tag Manager, to:

  • Enhance your browsing experience and website functionality
  • Analyze website traffic and user behavior to improve our services
  • Personalize content and advertisements
  • Collect statistical information about website usage

    • When you first visit our website, you will be asked to consent to our use of cookies. You can choose to accept or reject non-essential cookies.
